I figured it out :)
If you're using CS4 you have to start over again and create a new Flash File (ActionScript 2.0) not 3.0 Then make sure when you save the file save it as a CS3 instead of a CS4 (in the drop down menu)
I found a bug, if you go high enough and crash into the bottom, you stay there and it does the crashing sound over and over, and any fish and rings around you float to the bottom and go off the screen
