is it illegal to make a gif or video that is designed to cause epileptec seizures?

in other words – would such a gif or video be allowed to exist in places such as Youtube, kongregate or any other website that would normally allow non epilepsy inducing content to be shared? What about on Telivision?

Links like this are judged in a case-by-case basis but some seizure inducing links are indeed forbidden here. Most of the time, they won’t directly send you to the corner, but you still should be considerate towards people with neural disorders.

I doubt that it would be illegal to create in the first place, but if you don’t have extremely obvious and explicit warnings about what is about to be seen, and someone is actually forced into an epileptic seizure, you would be practically guaranteed to have a very substantial lawsuit on your hands – a lawsuit which you would very likely lose. Amusement park rides that include bright and/or flashing lights have to post warning signs up all throughout the waiting line, and games like Audiosurf force you to view their disclaimer every time you launch the game. Failing to warn someone about something that could potentially kill them is the illegal part.

Quite a while back there was a thread with gifs that could cause an epileptic seizure, a mod came in and warned the users on the basis that Emily Greer suffers from epilepsy.

So, chances are posting such a thing on Kongregate is bad idea, despite the fact I doubt she bothers herself with OT or most forums.

But no, making such a thing is not illegal, but as XtremeHairball said, you will have to warn people.

It’s hard for epilepsy to kill people directly. That’s why it was funny when a bunch of assholes tricked a forumful of people into clicking on seizure-inducing threads.
