Not true. Eating someone does not kill them. To quote one of the Orcs from the second LotR movie:

Grishnákh: What about their legs? They don’t need those. Ooh! They look tasty!

If someone gets prosecuted for killing someone and killing the person then he will be prosecuted for cannibalism and murder, not just cannibalism. Murder, killing and cannibalism are three different concepts. Mixing them together will only result in misunderstandings, as can be seen in SpikeofAcid fallacious line of argumentation.
