This very well may be the SAME creator, however he may have been commissioned to make the spiderman version, and restricted on where he could post it.
As such, it's entirely possible that the elements were changed to prevent infringement. And if you look at the spiderman game it is also listed as created by Gamezhero. Hence, I don't believe this is stolen, merely modified by it's creator.
