Historical discrimination? I hope that isn’t a reference to the Civil War, becuase the ignorance surrounding that war is astounding. Abraham Lincoln was a white supremacist, and Jefferson Davis had a black foster son(who was torn from his mothers arms by Union cavalrymen, and never heard from again.) Don’t start trying to use “Historical discrimination” to validate YOUR point of view.

14th Amendment.
Anyone who wishes to live in the U.S. and add to our wonderful melting pot is welcome, it’s the ones who abuse this and ultimately end up living in another country with a U.S. citizen status is why this measure has been concocted.
It isn’t about immigration. If a child is born on U.S. soil, meaning he is then a U.S. citizen. Then that also means that he has the right to be treated as one. Regardless of what his parents did. He can’t be held accountable for there actions. The same argument your trying to make would be just like trying to argue that if a father of a 2 year old child went on a murderous rampage, that the child should be held accountable, or like trying to argue that if a father were to say take a loan of 1,000,000 dollars, then become unable to pay it back, that the child should be held accountable.

HOT OFF THE PRESS: California's Prop. 8 ban on gay marriage ruled unconstitutional
I’d say that the 14th amendment is enough in itself to render the ban unconstitutional. I could also argue that it restricts the right to peacefully assemble, and the right of free speech.
As for bias because he is openly gay. I would say not at all, and that he’s actually less biased, compared to a straight, or Christian judge. That would be kind of like if the justice of a case concerning equal rights for blacks, happened to be black himself, and then when he ruled against non-equal rights. They called him biased. When In truth he’s much less biased. Since it is the opposers to equal rights, that are biased against him.
In other words. I would say that all the Homophobics, and Fundamentalist Christians, who oppose this are biased against the Homosexuals. Not the Court Judge.

I am an Athiest as to quote Carl Sagan “Extraordinary claims require extraordinary evidence”, Religion has yet to provided any solid evidence of god, whilst we have seen much evidence of Abiogenesis, Evolution, and The Big Bang scenario.

Party views change over time. Back then The Republican Party followed more so what we see as modern Democratic views today. Whilst the same goes for The Democratic Party historically, whats important is the views and ideals of the parties right now. Not them a few hundred years ago.

The parties switched ideologies (for the most part) in the mid 20th century. The proof is that what they said almost entirely flipped, as did their bases of support. The transformation was done in large part by FDR and it slowly built up to the near-full flip. For example, the South used to be a Democratic stronghold, and it is now a Republican one. Overall the citizens’ ideologies in the South have not changed.
