The man had been diagnosed with bipolar disorder and delusional psychosis, according to a consultant forensic psychologist. Mr Shaikh’s family said he had been delusional and duped into a carrying a suitcase that did not belong to him when he was found with 4kg of heroin in Urumqi, north-west China, in September 2007. However, in order to prove that he had these mental issues, the Chinese said that he would have to prove it himself, and refused to give him a psychiatric assessment. Because there was a lack of official medical records that said he had the mental issues, he could not prove it himself.

The difference between the Chinese and the American justice systems seems to be that the American system is more compassionate, and will acknowledge the mental stability of a person who is on trial. The Chinese justice system seems to not acknowledge the mental stability of a person who is on trial, and is just focused on punishing the person for their actions. They even refused to acknowledge his mental illness for being the reason for his actions. I do not think this is right, and it is quite barbaric. Many people today have mental disorders, but the Chinese just refuse to recognize them.

What do you think of the way China handled this case?
