What you should do is first send an email to the owner of FlashGameVault at andrew.g.johnson@gmail.com (I looked his email up at register.com). And then also send an email to his webhost http://www.bluehost.com/contact_us.html at tos@bluehost.com and inform them that FlashGameVault is in violation of their own TermsOfService articles 9.06 and 10. They're required by law to terminate his account if such a violation occurs.
