If you die and didn't get the achievement even though you hit level 42, all you have to do is wait at the score screen until the game catches up. The "Best so far:" will slowly count up to 42.

I found the guy of my dreams! OH MY GOD, HE'S A MURDERER!?!?! Oh well, he looks exactly how I pictured him. I'll just ignore that bad part.
